Determine if you are required to have a DOT drug & alcohol testing program
How do you know if your trucking company is required to have DOT drug and alcohol testing? Follow this formula:
Do you nave CDL drivers operating commercial motor vehicles (CMV) on public roads in vehicles that:
- have a gross vehicle weight rating/gross vehicle weight or gross combination weight rating/gross combination weight of 26,001 or more lbs., or
- are designed to carry 16 or more passengers (including the driver), or
- are of any size that is used to transport hazardous materials which require the vehicle to be placarded
If you say yes to any of the above, these drivers are considered covered employees for the DOT – Federal Motor Carrier Safety Admin (FMCSA) drug and alcohol testing program.
Implement a DOT drug & alcohol testing policy
A written drug & alcohol testing policy is required. It must include various components under the DOT FMCSA regulations. These components include:
- When drug and/or alcohol testing is required
- Information about the drug and alcohol testing process
- Consequences for violation of the policy - positive tests or refusals
- Information about the return to duty process
Provide educational materials to your drivers
The FMCSA regulations require that you provide educational materials to your drivers. This education must include:
- Who is the company designated employer representative (DER) for the company
- Which drivers are covered under the policy
- When do the provisions of the policy apply
- What driver conduct is prohibited
- When drug & alcohol testing occurs
- How the testing processes work
- What constitutes a refusal to test
- Removal from covered position after a violation
- Harmful effects of using illicit substances while working
- FMCSA Clearinghouse requirements – queries and violation reporting
Provide reasonable suspicion supervisor training to your supervisors
Your company must ensure that all persons designated to supervise drivers receive at least 60 minutes of training on alcohol misuse and receive at least an additional 60 minutes of training on controlled substances use. This is typically a two-hour training program. The training will be used by the supervisors to determine whether reasonable suspicion exists to require a driver to undergo testing. The training shall include the physical, behavioral, speech, and performance indicators of probable alcohol misuse and use of controlled substances. Register in the FMCSA Clearinghouse, query new drivers & run annual queries
The FMCSA Clearinghouse is an online database of driver violations managed by the Federal Motor Carrier Safety Administration. Employers have responsibilities in the Clearinghouse that include:
- Employer registration in the Clearinghouse
- Run queries on new drivers before they drive and run annual querie
- Update your policy and education materials to include FMCSA Clearinghouse requirements for drivers
- Report alcohol test violations, actual knowledge of drug or alcohol use and employer determined refusals to test
- Report negative return to duty tests when a drivers returns to work after a violation and completion of the substance abuse professional (SAP) program

Conduct required drug & alcohol testing including pre-employment testing
Drug and alcohol testing of your drivers is a required component of your DOT drug testing program. Testing is required to occur for:
- Pre-employment – before the driver operates the commercial motor vehicle (CMV)
- Random – consortium or standalone random program
- Reasonable suspicion when a trained supervisor determines physical, behavioral, speech, and performance indicators of probable alcohol misuse and use of controlled substances.
- Post-accident under FMCSA Criteria for DOT post-accident drug & alcohol test
- Return to duty testing after completion of substance abuse professional (SAP) program
- Follow up testing as determined by the substance abuse professional (SAP)
Remove drivers that have violations or a prohibited status
Keep complete records of your program
As with any type of policy or safety program, records are important; and documentation must be maintained. The third-party administrator (TPA) for you drug testing program can assist with some of the record record-keeping but the employer has responsibilities also.
