Some are conducted via mail or electronic. &nbsp;What to expect:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>FMCSA Information on New Entrant Safety Audit<\/strong><\/h3>\n\n\n\n<p><strong>For the drug and alcohol testing program, the new entrant must show documentation of the following:<\/strong>&nbsp;<\/p>\n\n\n\n<ul><li>Alcohol and drug testing policies and instructions for implementing your program.&nbsp;<\/li><li>Copies of written consent forms you sent to obtain 40.25 drug and alcohol information from previous employers, and the responses received from those employers.&nbsp;<\/li><li>Copies of written consent forms you received from prospective employers for 40.25 information, and documentation of your responses.&nbsp;<\/li><li>Educational materials for employees.&nbsp;<\/li><li>Documentation showing how education materials were made available to employees.&nbsp;<\/li><li>List of supervisors responsible for making reasonable suspicion and reasonable cause determinations.&nbsp;<\/li><li>Supervisory training lesson plans and course materials.&nbsp;<\/li><li>Attendance lists for supervisors who received this training.&nbsp;<\/li><li>Pre-employment testing records.&nbsp;<\/li><li>Information about the type of method used to select employees for random testing.&nbsp;<\/li><li>Names of all employees in the random testing pool for each selection period that the DOT Agency will review.&nbsp;<\/li><li>Names of all employees selected for testing.&nbsp;<\/li><li>&nbsp;Names of all employees actually tested.&nbsp;<\/li><li>CCFs and ATFs showing employees were tested within the selection period.&nbsp;<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>A New Entrant will AUTOMATICALLY FAIL the Safety Audit for violations related to:<\/strong><\/p>\n\n\n\n<p><strong>Alcohol and Drug Violations<\/strong><\/p>\n\n\n\n<ul><li>No alcohol and\/or drug testing program.<\/li><li>No RANDOM alcohol and\/or drug testing program.<\/li><li>Using a driver who refused a required alcohol or drug test.<\/li><li>Using a driver the company knows had a blood alcohol content of 0.04 or greater.<\/li><li>Using a driver who failed to complete required follow-up procedures after testing positive for drugs.&nbsp;<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Driver Violations<\/strong><\/p>\n\n\n\n<p>A New Entrant fails the Safety Audit for knowingly:<\/p>\n\n\n\n<ul><li>Using a driver without a valid CDL.<\/li><li>Using a disqualified driver.<\/li><li>Using a driver with a revoked, suspended, or cancelled CDL.<\/li><li>Using a medically unqualified driver.&nbsp;<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Operations Violations<\/strong><\/p>\n\n\n\n<ul><li>Operating a motor vehicle without having in effect the required level of insurance.<\/li><li>Failing to require drivers to make hours-of-service records.&nbsp;<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Repairs and Inspections Violations<\/strong><\/p>\n\n\n\n<ul><li>Operating a vehicle declared Out-of-Service for safety deficiencies before repairs are made.<\/li><li>Not performing OOS repairs reported in driver-vehicle inspection reports (DVIRs).<\/li><li>Operating a CMV not periodically inspected.&nbsp;<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Results of the Safety Audit<\/strong><\/p>\n\n\n\n<p>If passed, FMCSA will continue to monitor the New Entrant\u2019s safety compliance and performance.<\/p>\n\n\n\n<p>If failed, New Entrants must satisfactorily implement a corrective action to correct safety management practices.
