Colorado has been one of the go-to states when it comes to making jokes about marijuana legalization. And even pre-employment screening is something that you\u2019ll need to consider more carefully due to the legalization of marijuana in the state.<\/p>\n\n\n\n

The main thing to keep in mind here? Legal marijuana doesn\u2019t mean that employers don\u2019t\u2019 have rights. You can still drug test employees \u2013 and the fact that federal law still outlaws the drug means that you have more rights than you might think.<\/em><\/p>\n\n\n\n

A recent case in the Colorado court of appeals confirmed that the federal law means that employers can sanction their employees how they feel is best for them \u2013 and that means that they can forbid employees from using marijuana \u2013 even outside of the workplace.<\/p>\n\n\n\n

It\u2019s worth noting that while using a Colorado random drug test<\/a> <\/strong>is a good idea for many \u2013 especially those in an industry that requires maximum safety \u2013 those with high turnover rates may find that drug testing for marijuana is too much to maintain a good working environment. Instead, employers need to take the time to think about their business and how marijuana use fits into it. Then, they should develop a drug testing policy that fits their needs.<\/p>\n\n\n\n
