Government employers should always call for potential additional restrictions on employee drug testing.<\/p>\n<p>Update on Illinois and Recreational Marijuana<\/p>\n<p><b>Illinois HB 1438 <\/b><\/p>\n<ul>\n<li><b>Legalizes recreational marijuana<\/b><b><\/b>effective&nbsp;January 1, 2020 for those ages 21 and older&nbsp;<\/li>\n<li>Employers are&nbsp;<b>not required <\/b>to permit employee use of marijuana&nbsp;while at work, while performing job duties, or while on call<\/li>\n<li>Requires certain changes to drug-free workplace policies and&nbsp;procedures:\n<ul>\n<li><b>Employers can have policies <\/b><b><\/b>addressing drug testing, smoking&nbsp;marijuana, marijuana storage, etc.,&nbsp;provided that the policy is&nbsp;applied in a <b>nondiscriminatory manner<\/b><\/li>\n<li>Employers are&nbsp;<b>not required <\/b>to accommodate employees&nbsp;being under the influence&nbsp;or the use of marijuana in the&nbsp;workplace<\/li>\n<li>Employers&nbsp;must have <b>\u201cgood faith belief\u201d <\/b>that an employee is&nbsp;under the influence&nbsp;\u2013 can be established using specific,&nbsp;articulable symptoms, but&nbsp;<b>not strictly a drug test<\/b><\/li>\n<\/ul>\n<\/li>\n<li>Employers should use a&nbsp;<b>positive drug test <\/b>for marijuana&nbsp;in conjunction&nbsp;with&nbsp;specific <b>signs and symptoms of impairment<\/b><b><\/b>before&nbsp;taking action<\/li>\n<li>Employers&nbsp;<b>cannot&nbsp;<\/b><b>take action<\/b><b><\/b>based on the use of lawful products&nbsp;(marijuana)&nbsp;outside of work hours<\/li>\n<li>Defers to federal, state, and local restrictions on employment, such as Part 40<\/li>\n<\/ul>\n<p>See our comprehensive State by State guide &#8211; <a href=\"https:\/\/www.nationaldrugscreening.com\/marijuana-considerations-laws-by-state\/\" target=\"_blank\" rel=\"noopener noreferrer\">Marijuana Considerations &amp; Laws by State<\/a><\/p>\n\n\n<p><\/p>\n","protected":false},"template":"","acf":[],"_links":{"self":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/us_state_laws\/50479"}],"collection":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/us_state_laws"}],"about":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/types\/us_state_laws"}],"version-history":[{"count":0,"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/us_state_laws\/50479\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/media?parent=50479"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
