Government employers should always call for potential additional restrictions on employee drug testing.<\/p>\n<p>2021 Update &#8211; Recreational marijuana is now legal.\u00a0 With limited exceptions, New York State employers cannot test for marijuana.\u00a0 This does not affect DOT drug testing. (see article published by Jackson Lewis P.C. &#8211; <a href=\"https:\/\/www.drugtestlawadvisor.com\/2021\/10\/new-york-department-of-labor-publishes-guidance-addressing-recreational-marijuana-in-the-workplace-most-drug-testing-for-marijuana-is-prohibited\/\">New York Department of Labor Publishes Guidance Addressing Recreational Marijuana In The Workplace; Most Drug Testing For Marijuana Is Prohibited<\/a>)<\/p>\n<p>New York employers can prohibit on duty use of marijuana and impairment while on duty.<\/p>\n<p>New York City has a law to prohibit employers from conducting pre-employment drug testing for THC (marijuana).\u00a0 There are exemptions including DOT testing and safety sensitive positions.<\/p>\n<p><strong>2020 Update<\/strong> &#8211; Regardless of CDL license status &#8211; for hire drivers of transporting 10 or more people at a time to submit to mandatory pre-employment drug testing.\u00a0 This testing should comply with DOT regulations 49 CFR Part 40.\u00a0 Some of this testing with drivers transporting less then 16 passengers including the driver would be a Non-DOT test &#8211; DOT Look a Like panel.<\/p>\n","protected":false},"template":"","acf":[],"_links":{"self":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/us_state_laws\/50498"}],"collection":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/us_state_laws"}],"about":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/types\/us_state_laws"}],"version-history":[{"count":0,"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/us_state_laws\/50498\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.nationaldrugscreening.com\/wp-json\/wp\/v2\/media?parent=50498"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
