Commercial trucks and bus drivers are subject to DOT drug and alcohol testing under this regulation as well as 49 CFR Part 40. Testing is also required in accidents in which one or more motor vehicles are towed from the scene or in which someone is treated medically away from the scene; and a citation is issued to the CMV driver.<\/p>\n\n<p><strong>Reasonable-suspicion determination:<\/strong>\u00a0One trained supervisor or company official can make the decision based upon specific, contemporaneous, articulable observations concerning the appearance, behavior, speech, or body odors of the employee.<\/p>\n\n<p><strong>Pre-duty alcohol use prohibitions:<\/strong>\u00a0Four (4) hours prior to performance of duty.<\/p>\n\n<p><strong>Actions for BACs 0.02 \u2013 0.039:<\/strong>\u00a0The employee cannot be returned to duty until the next day or the start of the employee\u2019s next regularly scheduled duty period, but not less than 24 hours following the test.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-df1787d elementor-widget elementor-widget-heading\" data-id=\"df1787d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Employee Training<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bc32de8 elementor-widget elementor-widget-text-editor\" data-id=\"bc32de8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p>Employer must provide educational materials explaining drug and alcohol regulatory requirements and employer\u2019s policies and procedures for meeting regulation requirements. Distribution to each employee of these educational materials and the employer\u2019s policy regarding the use of drugs and alcohol is mandatory.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4ea42b0 elementor-widget elementor-widget-heading\" data-id=\"4ea42b0\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Supervisor Training<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b994cd0 elementor-widget elementor-widget-text-editor\" data-id=\"b994cd0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p>One-hour of training is required on the specific, contemporaneous physical, behavioral, and performance indicators of probable drug use.
